Welcome to the USATACTICS.COM website run by IDNMEDIA, Inc. and its affiliate, ("IDNMEDIA," "we," "us," or "our"). IDNMEDIA is committed to respecting the privacy rights and concerns of all users of our USATACTICS.COM ("USATACTICS.COM", "USATACTICS.NET", "USARPG.COM" and "USARPG.NET") website and/or service (collectively, the "Site") and our PC game entitled "USATACTICS" and related software (the "Software") (we refer to the Site and the Software collectively as the "USATACTICS Features"). As such, we have established and implemented this privacy statement to inform visitors to the Site and users of the Software how we use and protect the information we collect. This privacy statement is effective as of October 17, 2007.

What information does IDNMEDIA collect?

IDNMEDIA does not collect personally identifiable information other than that which our visitors voluntarily provide it to us, such as when you set up an account. The following sections describe what type of information we collect, when we collect it and how we use it.

Setting up an account

In order to use certain functionality of the USATACTICS Features, we ask that you submit certain personal information to create a user account. When you register and create an account, we ask for certain information including your e-mail address and your age. Upon activating an account, we will ask you to select a user name and password that will be used so you can securely access and maintain your account.

Cookies

Cookies are small pieces of electronic information that a web site can transfer to a visitor's hard drive to help tailor and keep records of his or her visit to the site. The use of cookies is common on the Internet and many web sites use them. Cookies allow web site operators to better customize visits to the site to the visitor's individual preferences. For example, by setting a cookie you would not have to blog in a user name or password more than once, thereby saving time. We currently save password information in cookies; however, we do not receive or record any personal information in the cookies we use.

Although most Web browsers automatically accept cookies, you can usually change your browser to prevent that or to notify you when you are sent a cookie. Even without accepting a cookie, you can still access the USATACTICS Features. However, to access your account, you will have to re-enter your user name and password each time you visit the Site.

Bulletin Boards, Blogs, User Forums and Chat Services

The USATACTICS Features might include certain community features such as blogs, bulletin boards, user forums and in-game chat services. While IDNMEDIA does not actively use any information posted on blogs, bulletin boards, user forums or in-game chat services, IDNMEDIA does keep an ongoing archive of some of such information for record-keeping purposes. We will display an account holder's user name when that account holder posts a message on a blog, bulletin board, or user forum. It is important for each account holder of the USATACTICS Features to understand that if he or she provides personal information in a blog, bulletin board or user forum posting or in-game chat session, other USATACTICS Features account holders will have access to that personal information.

Customer Service

We provide customer service support through e-mail, FAQ and our searchable database. In order to provide customer support, in some cases, we will ask for your e-mail address and user name. Aside from this information, we do not ask for any personal information to provide customer support. We only use information received from customer support requests, including e-mail addresses and user names, for customer support services and we do not transfer or share this information with any third parties.

How do we use the information you provide us?

As stated above, we will use your e-mail address and user name to contact you when we provide customer support.

In addition, we may also use your e-mail address to send you information on updates to the USATACTICS Features from time to time. To opt out of receiving these e-mails, please see the section below titled "How do you opt out?" Please note that if you are participating in a pre-release testing program for the USATACTICS Features, such as an Alpha test or a Beta test, should you opt out, you may no longer be able to participate in the applicable testing program.

We may also provide information about our visitors and account holders to outside parties from time to time. For further details, please see the section below titled "Does IDNMEDIA disclose the information it collects to outside parties?"

We may use the information we collect to tailor your experience through the USATACTICS Features by providing a faster method for you to access your account and submit information to us and allowing us to contact you, if necessary, such as when you win a contest or sweepstakes.

How does IDNMEDIA protect customer information?

We implement a variety of security measures to ensure the security of your personal information on our systems. User personal information is contained in secured networks and is only accessible by a limited number of employees and contractors who have special access rights to such systems. Any credit card information you supply us is transmitted and protected via Secure Socket Layer technology ("SSL") and then stored into our databases to be accessed only as stated above.

Does IDNMEDIA disclose the information it collects from its visitors to outside parties?

IDNMEDIA does not currently sell, trade, or otherwise transfer outside the company, its affiliate entities (such as its publisher), or its contractors (such as its customer support representatives) personally identifiable information that account holders voluntarily provide in any account registration, sweepstakes or contest submission. This information is used to better understand how account holders use the USATACTICS Features, to support related transactions made on the site, and to better know our visitors and possibly tailor any specific features, promotions, or other notifications to them. However, this data in an aggregate form without any personally identifiable information may be provided to other parties for marketing, advertising, or other uses. Should you change your mind about permitting IDNMEDIA to store the personal information you provided to us, should you no longer wish to receive information from us, or should your information change, we have provided a way for you to correct, update or remove the personal data you gave us. In the event IDNMEDIA goes through a business transition, such as a merger, is acquired by another company, or sells a portion of its assets, account holders' information will, in most instances, be part of the assets transferred. Should any of these events occur, visitors and account holders will be notified via prominent notice on the Site for 30 days prior to a change of ownership or control of user information held by us. If, as a result of the business transition, information will be used in a way inconsistent with this Privacy Statement, users will have a choice with regard to their information as described in
"How do you change the information we have for you?"
Notwithstanding any other term of this privacy statement, we may release any personal information we obtain or collect when we believe its release is appropriate to comply with the law, enforce our USATACTICS Features policies, or protect ours or others' rights, property, or safety.

Individuals under 13 years of age.

In accordance to the 1998 Federal Children's Online Privacy Protection Act ("COPPA"), our policy is not to collect information from individuals under the age of 13 years. If you are under 13 years of age, you are not permitted to use the USATACTICS Features. We therefore do not knowingly collect personal information from individuals under the age of 13 years of age. Should you register to this game, we are considering this registrations as, among other things, your statement that you are 13 years of age or older; All other data contradicting this statement, including filling the date of birth fields, is considered void and/or imaginary.

How do you opt out?

If you wish to no longer receive e-mail and notifications from us, please contact us through support@usatactics.com, in this matter.

How do you change the information we have for you?

To update, modify or delete the information that we have on file for your account, simply log in or click [profile], then click [edit] - under [profile], there you may modify or delete your personal information and settings as you wish. If you wish to delete your email address, you will be required to terminate your account.

Third party links and co-brand relationships.

In an attempt to provide increased value to our visitors, we may choose various third party web sites to link to, and frame within, the Site. We also participate in co-branding and other relationships to offer e-commerce and other services and features to our visitors and account holders. However, even if the third party is affiliated with us, we have no control over these linked sites, each of which may have separate privacy and data collection practices independent of us. Data collected by our co-brand partners or third party web sites (even if offered on or through our site) may not be received by us. As such, we have no responsibility or liability for the actions of these third parties and are not responsible for the privacy practices or the content of any third party web sites. These linked sites are only for your convenience and you therefore access them at your own risk.

Polls

Polls are issued from time to time either by us or by fellow account holders. Participation in these polls is completely voluntary and you therefore have a choice whether or not to disclose this information. Information requested may include contact information (such as your email address), and demographic information (such as interests or age level). Poll information will be used for purposes of monitoring or improving the use and satisfaction of the USATACTICS Features and will not be transferred to third parties.

Notification of changes.

By visiting the Site or using the Software, you consent to the collection and use of information by us as set forth in this privacy statement. If we decide to change our privacy statement, we will post those changes within this page so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

Terms and Conditions

Please also read the Terms of Service establishing the use, disclaimers, and limitations of liability governing the use of the Site, the Software and other IDNMEDIA services and applications, and the associated click-through Nondisclosure Agreement and click through End User License Agreement for the Software.

Disclaimer and Terms of Service

1.	Remember, USATACTICS is just a game.
2.	USATACTICS accepts no responsibility for the actions of its members outside of the game.
3.	USATACTICS will not be held responsible and does not encourage any immoral or illegal actions or any other form of anti-social behavior.
4.	Although USATACTICS is highly addictive. We encourage you to spend time with your family and loved ones, and to step away from the game in periods of stress or frustration caused by the game or outside sources.
5.	The Terms of Service below can be changed at any time. Any major change to these Terms of Service will be announced in game as well as on our forums, but it is the responsibility of the player to be aware of and comply to these Terms of Service at all times. Failure to be in compliance with these Terms of Service may result in the immediate suspension of your account(s).
6.	In addition to these Terms of Service, there is a list of Game Rules (at About the Game & Game Rules). Anything stated in the Game Rules is in Addition to the Terms of Service and does not counter anything listed in the Terms of Service. Any unintended results from both the Game Rules and Terms of Service are to be judged by the game owners. By agreeing to the Game Rules, you agree to the Terms of Service and by agreeing to the Terms of Service, you agree to the Game Rules.
7.	Players agree to abide by all Game Rules and understand that any violation will result in a given punishment.
8.	You are only allowed to have one account. Players found to have multiple accounts will have access to all accounts removed.
9.	You are responsible for your account. Any actions by your account, whether by yourself or by someone else, will be a reflection of you. Breaking Game Rules or Terms of Service may lead to account suspension regardless of who has control of your account.
10.	Every player must respect other players and game staff. You must not discriminate against someone because of his or her age, gender, skin color, sexual preference, religion or personal beliefs. Any player found to be actively discriminating against another player or member of society in any way, will have their accounts terminated and further action may be taken. This includes, without limitation, character name, message board posts and chat rooms.
11.	Account sharing is against forbidden.
12.	USATACTICS encourages and allows users to post and/or exchange opinions, information, and ideas. Please be advised that these player generated opinions, information and ideas do not necessarily reflect the views of USATACTICS. While we occasionally do monitor player generated content, in no event does USATACTICS assume or have any responsibility or liability for any of this content or for any claims, damages or losses resulting from their use and/or appearance on or in conjunction with this Site or elsewhere. Users remain individually responsible for their ideas, messages and opinions. However, USATACTICS still has the right to modify/delete and refuse to post any player generated content that violates these Terms and Conditions. Privileges to post ideas that violate these Terms and Conditions may also be revoked.
13.	Donations and/or payments of any sort made to USATACTICS towards running and maintenance costs and/or any other premium features made through an online vendor or any other type of money transfer means (including billing by sms) are non-refundable.
14.	USATACTICS does not guarantee or make any representations regarding the use or the results of donating/paying through sites such as paypal with regard to their correctness, accuracy, reliability or otherwise. The entire risk is carried by you (i.e. not USATACTICS). You assume the complete cost of any necessary servicing, repair or correction.
15.	Players agree not to, through software or other methods, interfere with the site operation and page content. This includes any method to manipulate the game in ways unintended by the creators.
16.	Players agree to follow all administrator requests and instructions.
17.	Other sections of the game may have their own rules. These rules are an addition to the Terms of Service and not a replacement. Violation of these rules is considered to be a violation of the Terms of Service and will be dealt with accordingly. Please make yourself familiar with all Game Rules before playing. Failure to be familiar with the Game Rules is not an excuse for breaking them and will not be accepted as a defense of your account.
18.	This site and all the materials contained on it are distributed and transferred on an "AS AVAILABLE" and "AS IS" basis, without warranties of any kind, either implied or express. To the fullest extent permissible under the applicable law, USATACTICS disclaims all warranties, implied or express, including, without limitation, warranties of merchantability or fitness for a particular purpose. USATACTICS does not guarantee that the functions or materials contained within this site will be uninterrupted and error-free, that defects will be corrected, or that this site and the servers that make it available are free of viruses and other harmful components.
19.	To the fullest extent permissible pursuant to applicable law, USATACTICS, it's Affiliates, and their respective officers, directors, agents, employees, licensors, representatives and third party providers to this site will not be liable for damages of any kind including, without limitation, incidental, indirect, special, consequential, compensatory or any similar damages, that may result from the use of, or the inability to use, the materials contained on this site, whether the material is supplied by USATACTICS or any third party.
20.	Not withstanding the foregoing, in no event shall USATACTICS have any liability to you for any claims, damages, losses, and causes of action (whether in contract, tort or otherwise).
21.	Any individual who attempts to hack, gain unauthorized entry, reverse engineer or affect the system integrity of USATACTICS(including attempting to access any internal part of the game from an offsite location) will be dealt with to the fullest extent of the law.
22.	Any uploaded files, be it pictures or text files and mail sent or received are not the responsibility of USATACTICS, but responsibility of the player that uploaded the file or sent the mail.
23.	USATACTICS takes no responsibility for content published by users of this site.
